The first and most crucial step in filing for a Green Card is called Labor Certification. In this step an employer has six months to try and find a US Citizen (Has to advertize in a newspaper and conduct interviews) after which it is is dertemined if the position can be filled by a non-us citizen. Firstly, Please read the Bill before drawing any conclusions, if you do not understand the terms used for Employment Based Immigration then please consult a good immigration attorney. Obtaining EB (Employment Based) Green Card is a three step process. Step 1: Labor Certification (now known as PERM) Step 2: Immigration Petition for Alien Worker and Step 3: Adjudication of the Immigrant Visa Application (approval means Issuing a Green Card to alien worker). Term Alien Worker is used for hard working immigrants who entered the U.S. legally. Whats going on : There are immigrants (legal alien workers) waiting in line for Green Card in Step 3. What are they waiting for: They are waiting Visa numbers (there is limited quota for each year). Why are they waiting: They are waiting because Visa numbers were lost due to USCIS and other Govt delays. What will this bill do: It will "RECAPTURE" lost numbers from previous years and grant these to the alien workers waiting in line(MOST ALREADY EMPLOYED IN THE U.S.) |
