Of course it could be used for that. 1st, H1N! Flu would be declared a "national emergency"; 2. Taking flu vaccine would be made "mandatory" to "preserve the health of the nation; 3. Refusal to take the vaccine would thus become a criminal act because the Declaration of Emergency has "Punitive Articles" within the act's proclamation. 4. Refunseniks are, ipso facto, law breakers; 5. Law breakers during the national emergency are held incommunicado for "the duration of the emergency".
