Absolutely. Both S. 2913 and H.R. 5889 completely fail to properly define and orphan work. Additionally in the case of international disputes most countries honor the shorter of the two Copyright protection time-periods involved. Only Canada has something similar to this. As it is the U.S. barely complies with the Berne Treaty. According to this treaty a creator owns and controls his/her work from the moment of creation without having to register it. S. 2913 and H.R. 5889 essentially make registration mandatory and provide a loophole that greatly shortens the protection period both of which violate the agreement signed at the Berne Convention. I don't know if Congress realizes or cares that these bills impact with an international treaty. The Senate Judiciary refused to answer the question. |
