Nothing directly in the bill effects ground water rights. However, indirectly it can be argued that this will allow states to regulate water use. Because of the quagmire caused by the "text change" (navigable to waters-of-the-US)this will be up to the courts to interpret, Answered by a visitor on Aug 19, 2009 11:44 PM -
It's not applicable. It doesn't cover ground water and specifically exempts ground water from the definition. Section 3, paragraph 9 "'ground waters' are treated separately from 'waters of the United States'..."
