To prohibit ticket resale profiteering in or affecting interstate commerce.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
- This Act may be cited as the `Interstate Ticket Resale Prohibition Act of 1994'.
SEC. 2. PROHIBITION OF TICKET RESALE PROFITEERING.
- (a) IN GENERAL- Chapter 89 of title 18, United States Code, is amended by adding at the end the following:
`Sec. 1822. Ticket profiteering
- `(a) Whoever knowingly, and for the profit of any individual or entity other than a non-profit entity, engages in the resale of a ticket, in or affecting interstate or foreign commerce, at a price that exceeds the broker's price, shall be fined under this title.
- `(b) As used in this section--
- `(1) the term `ticket' means any evidence of the right or entry to any place of entertainment;
- `(2) the term `place of entertainment' means a place where there is any form of entertainment, diversion, recreation, or show, and to which there is an admission charge;
- `(3) the term `broker's price' means a price $5 greater than--
- `(A) the price printed or otherwise indicated on the ticket; or
- `(B) in the absence of that, the price set by the operator of the place of entertainment for the admission to that place evidenced by such ticket; and
- `(4) the term `resale' means any sale of a ticket other than by the operator (or operator's agent) of the place of entertainment to which the ticket pertains.'.
- (b) CLERICAL AMENDMENT- The table of sections at the beginning of chapter 89 of title 18, United States Code, is amended by adding at the end the following new item:
- `1822. Ticket profiteering.'.
