Can I assume that this bill applies only to federal loans and not to private? -

A1: From my reading, "Student Loan" is defined as either a Stafford Loan, a Perkins Loan, or a Federal Direct Consolidated Loan. So, safe answer is "yes," it only applies to federal loans or federally consoidated loans. I'm not sure if you can consolidate your private loans into a Federal Direct Consolidation.
Again, this is just my reading of it. See Part JJ, Sec. 3001(b)(3)(A).
?(i) a loan made, insured, or guaranteed under part B of title IV of the Higher Education Act of 1965 (20 U.S.C. 1071 et seq.);
?(ii) a loan made under part D or E of title IV of the Higher Education Act of 1965 (20 U.S.C. 1087a et seq. and 1087aa et seq.); and
?(iii) a loan made under section 428C or 455(g) of the Higher Education Act of 1965 (20 U.S.C. 1078-3 and 1087e(g)). [Answer submitted on Aug 20, 2008 3:20 PM]

A1: I contacted the Department of Education and they stated that before anybody can apply for loan forgiveness they first need to publish regulations for the enacted bill. He said this may take up to one year but more likely it will be within a few months. [Answer submitted on Aug 22, 2008 10:00 AM]
