To amend the Solid Waste Disposal Act to prohibit the transportation of solid waste from the State in which the waste was generated to another State for purposes of treatment, storage, or disposal, unless the State in which the waste was generated has in effect a law prohibiting nonreturnable beverage containers.

A BILL

To amend the Solid Waste Disposal Act to prohibit the transportation of solid waste from the State in which the waste was generated to another State for purposes of treatment, storage, or disposal, unless the State in which the waste was generated has in effect a law prohibiting nonreturnable beverage containers.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ‘Interstate Recycling Promotion Act’.

SEC. 2. PROHIBITION ON SHIPPING WASTE OUTSIDE STATES WITHOUT BOTTLE BILLS.

    (a) PROHIBITION- (1) Subtitle D of the Solid Waste Disposal Act (42 U.S.C. 6941 et seq.) is amended by adding at the end the following new section:

‘SEC. 0411. PROHIBITION ON SHIPMENT OF WASTE OUTSIDE CERTAIN STATES.

    ‘It shall be lawful for any State to exclude from treatment, storage or disposal within its boundaries any quantity of solid waste from any other State which does not have, at a minimum, a substantially equivalent State law promoting or requiring the recycling of any portion of the solid waste products involved. Such laws shall include but not be limited to a law prohibiting the manufacture, sale or introduction into commerce of any nonreturnable beverage container with respect to which no reasonable refundable money deposit is required by consumer.’.

    (2) The table of contents for such Act is amended by inserting the following after the item relating to section 4010:

      ‘Sec. 4011. Regulation on shipment of waste between certain States’.

    (b) EFFECTIVE DATE- Section 4011 of the Solid Waste Disposal Act, as added by subsection (a), shall take effect on January 1, 1994.
