A BILL

To revive and extend until December 31, 1996, the suspension of duty on certain chemicals, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. REVIVAL AND EXTENSION OF SUSPENSION OF DUTY ON CERTAIN CHEMICALS.

    Each of the following subheadings in subchapter II of chapter 99 of the Harmonized Tariff Schedules of the United States is amended by striking out ‘12/31/92’ and inserting ‘12/31/96’:

      (1) Heading 9902.29.74 (relating to Terfenadone).

      (2) Heading 9902.29.95 (relating to clomiphene citrate).

      (3) Heading 9902.29.96 (relating to dicyclomine).

      (4) Heading 9902.29.99 (relating to terfenadine and mepenzolate bromide).

      (5) Heading 9902.30.00 (relating to desipramine hydrochloride).

      (6) Heading 9902.30.03 (relating to lactulose).

      (7) Heading 9902.30.04 (relating to nicotine resin complex put up in measured doses in chewing gum form).

      (8) Heading 9902.30.06 (relating to rifampin).

      (9) Heading 9902.30.49 (relating to L-ornithine, ethyl ester).

      (10) Heading 9902.30.50 (relating to (+)-cis-(2s,3s)-3-(Acetoxy)-8-chloro-5-[2-(dimethylamino)-ethyl]-2,3-dihydro-2-(4-methoxyphenyl)-1,5-benzothiazepin-4(5H)one maleate (cletiazim maleate)).

      (11) Heading 9902.30.61 (relating to diltiazem hydrochloride).

      (12) Heading 9902.31.03 (relating to teicoplanin).

      (13) Heading 9902.31.06 (relating to sucralfate).

SEC. 2. AMENDMENT TO DUTY SUSPENSION FOR RIFAMPIN.

    Heading 9902.30.06 of the Harmonized Tariff Schedules of the United States (relating to rifampin) is further amended by inserting after ‘subheading 2941.90.30’ the following: ‘and subheading 3004.20.00’.

SEC. 3. AMENDMENT TO DUTY SUSPENSION FOR TEICOPLANIN.

    The article description in heading 9902.31.03 of the Harmonized Tariff Schedules of the United States (relating to teicoplanin) is amended to read as follows: ‘Teicoplanin (provided for in subheading 3003.20.00 or 3004.20.00)’.

SEC. 4. EFFECTIVE DATE.

    (a) IN GENERAL- The amendments made by sections 1 through 3 apply to goods entered, or withdrawn from warehouse for consumption, after December 31, 1992.

    (b) RETROACTIVE PROVISION- Notwithstanding section 514 of the Tariff Act of 1930 or any other provision of law to the contrary, upon a request filed with the appropriate customs officer before the 90th day after the date of enactment of this Act, any entry or withdrawal from warehouse for consumption of a good to which any of sections 1 through 3 apply, shall, if the entry or withdrawal was made--

      (1) after December 31, 1992; and

      (2) before the 15th day after the date of enactment of this Act;

    be liquidated or reliquidated as though the applicable amendments made by sections 1 through 3 applied to such liquidation or reliquidation.
