A BILL

To authorize noncompetitive, career or career-conditional appointments for temporary and term employees of the Federal Deposit Insurance Corporation, including those assigned to the Resolution Trust Corporation, who are separated due to downsizing and office closures or due to the termination of the Resolution Trust Corporation.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ‘Temporary Employee Placement Assistance Act’.

SEC. 2. NONCOMPETITIVE CAREER OR CAREER-CONDITIONAL APPOINTMENTS FOR SEPARATED TEMPORARY OR TERM EMPLOYEES OF THE FEDERAL DEPOSIT INSURANCE CORPORATION, INCLUDING THOSE ASSIGNED TO THE RESOLUTION TRUST CORPORATION.

    (a) IN GENERAL- An individual described in subsection (b) may be appointed noncompetitively, under a career or career-conditional appointment, to a position in the competitive service if--

      (1) the individual meets the qualification requirements prescribed by the Office of Personnel Management for the position to which appointed;

      (2) the last previous Federal employment of the individual was as a temporary or term employee who was employed for at least two years by the Federal Deposit Insurance Corporation, including a temporary or term employee of the Federal Deposit Insurance Corporation assigned to the Resolution Trust Company; and

      (3) the appointment is effected within three years following the date of separation from the last position described in paragraph (2).

    (b) INDIVIDUAL DESCRIBED- An individual described in this subsection is an individual who--

      (1) on the date of the enactment of this Act--

        (A) is or was an employee of the Federal Deposit Insurance Corporation, including an employee assigned to the Resolution Trust Corporation; and

        (B) is serving or served in an appointed position described in subsection (a)(2) whose employment has been or will be terminated by involuntary separation, resignation in lieu of involuntary action, or expiration of appointment due to Federal Deposit Insurance Corporation downsizing or office closure, or Resolution Trust Corporation downsizing or office closure, or the termination of the Resolution Trust Corporation; and

      (2) is not separated from the position referred to in paragraph (1)(B) for cause.
