To amend the Federal Water Pollution Control Act concerning the eligibility of officers and employees of State, county, and municipal governments to serve as members of State boards that issue permits for discharges into the navigable waters.

Mr. LEHMAN introduced the following bill; which was referred to the Committee on Public Works and Transportation


A BILL

To amend the Federal Water Pollution Control Act concerning the eligibility of officers and employees of State, county, and municipal governments to serve as members of State boards that issue permits for discharges into the navigable waters.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. MEMBERSHIP OF STATE PERMITTING BOARDS.

    Section 304(i)(2)(D) of the Federal Water Pollution Control Act (33 U.S.C. 1314(i)(2)(D)) is amended by inserting before the closing parentheses the following: ‘; except that such requirement shall not apply to an officer or employee of a State, county, or municipal government if the officer or employee does not to participate in permit determinations involving such State, county, or municipal government’.
