A BILL

To amend the Solid Waste Disposal Act to prohibit a certain requirement from applying to out-of-State municipal solid waste generated and disposed of within the same bi-State level A metropolitan statistical area.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ‘Bi-State Waste Disposal Efficiency Act’.

SEC. 2. PROHIBITION ON APPLICATION OF CERTAIN REQUIREMENT TO CERTAIN WASTE.

    (a) PROHIBITION- The Solid Waste Disposal Act (42 U.S.C. 6901 et seq.) is amended by adding at the end of subtitle D the following new section:

‘SEC. 4011. PROHIBITION ON APPLICATION OF CERTAIN REQUIREMENT TO CERTAIN WASTE.

    ‘Notwithstanding any other provision of law, any requirement in a Federal law that an owner or operator of a landfill or incinerator obtain authorization to receive out-of-State municipal solid waste shall not apply if the out-of-State waste is generated within, and the landfill or incinerator is located within, the same bi-State level A metropolitan statistical area (as defined by the Office of Management and Budget and as listed by the Office of Management and Budget as of the date of the enactment of this section) which contains two contiguous major cities each of which is in a different State.’.

    (b) TECHNICAL AMENDMENT- The table of contents for subtitle D of such Act is amended by adding at the end the following new item:

      ‘Sec. 4011. Prohibition on application of certain requirement to certain waste.’.
