A BILL

To amend the Robert T. Stafford Disaster Relief and Emergency Assistance Act to impose a limitation on State eligibility for major disaster and emergency assistance to ensure that States repay loans and advances made under that Act.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. LIMITATION ON ELIGIBILITY FOR MAJOR DISASTER AND EMERGENCY ASSISTANCE.

    Title III of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5141-5164) is amended by adding at the end the following:

‘SEC. 322. LIMITATION ON ELIGIBILITY FOR ASSISTANCE.

    ‘(a) IN GENERAL- A State shall not be eligible for assistance under this Act, other than essential assistance under section 402, if--

      ‘(1) the State has received a loan or advance under section 319 and the State is not in compliance with the repayment terms of such loan or advance; and

      ‘(2) the State has enacted, in the 2-year period preceding the date of application for such assistance, laws that have reduced or are likely to reduce annual tax revenues received by the State by 1 percent or more.

    ‘(b) REGULATIONS- The President shall issue regulations to carry out this section.

    ‘(c) APPLICABILITY- This section shall not preclude a State from receiving assistance under this Act for a major disaster or emergency occurring before the date of the enactment of this Act.’.
