A BILL

To prohibit the regulation of the sale or use of tobacco or tobacco products by the Secretary of Health and Human Services.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. PROHIBITION.

    (a) IN GENERAL- The Secretary of Health and Human Services may not regulate the sale or use of tobacco or tobacco products under the Federal Food, Drug, and Cosmetic Act and may not take any action with respect to tobacco or tobacco products under the Federal Cigarette Labeling and Advertising Act or the Comprehensive Smokeless Tobacco Health Education Act of 1986 which was not authorized before the date of the enactment of this Act.

    (b) REGULATIONS- Any regulation issued by the Secretary of Health and Human Services relating the regulation of the sale or use of tobacco or tobacco products which takes effect before the date of the enactment of this Act shall on such date be considered as repealed.

    (c) CONSTRUCTION- This Act shall not be construed as a statement that the Secretary of Health and Human Services had the authority to regulate the sale or use of tobacco or tobacco products before the date of the enactment of this Act.
