Mr. CLINGER (for himself, Mr. ENGLISH of Pennsylvania, Mr. FOX of Pennsylvania, Mr. GEKAS, Mr. GREENWOOD, Mr. KLINK, Mr. MCDADE, Mr. SHUSTER, Mr. WALKER, and Mr. MASCARA) introduced the following bill; which was referred to the Committee on Ways and Means


A BILL

To provide for modification of the State agreement under title II of the Social Security Act with the State of Pennsylvania with respect to certain students.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. EXEMPTION FOR STUDENTS EMPLOYED BY STATE SCHOOLS, COLLEGES, OR UNIVERSITIES OF PENNSYLVANIA.

    Notwithstanding section 218 of the Social Security Act, the agreement with the State of Pennsylvania (or any modification thereof) entered into pursuant to such section may, at the option of such State, be modified at any time before January 1, 1998, so as to exclude service performed in the employ of a school, college, or university if such service is performed by a student who is enrolled and is regularly attending classes at such school, college, or university.

SEC. 2. EFFECTIVE DATE OF MODIFICATION.

    Any modification of an agreement pursuant to section 1 shall be effective with respect to services performed after the end of the calendar quarter following the calendar quarter in which such agreement is modified.

SEC. 3. IRREVOCABILITY OF MODIFICATION.

    If any modification of an agreement pursuant to section 1 terminates coverage with respect to service performed in the employ of a school, college, or university, by a student who is enrolled and regularly attending classes at such school, college, or university, the Commissioner of Social Security and the State may not thereafter modify such agreement so as to again make the agreement applicable to such service performed in the employ of such school, college, or university.
