A BILL

To amend the Public Buildings Act of 1959 to improve the management and operations of the General Services Administration.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ‘General Services Administration Improvement Act of 1997’.

SEC. 2. PROSPECTUS REQUIREMENTS FOR COURTHOUSES.

    (a) REQUIRED INFORMATION- Section 7(a) of the Public Buildings Act of 1959 (40 U.S.C. 606(a)) is amended--

      (1) by striking ‘and’ at the end of paragraph (5);

      (2) by striking the period at the end of paragraph (6) and inserting ‘; and’; and

      (3) by adding at the end the following:

      ‘(7) with respect to any project for the design or construction of a United States courthouse--

        ‘(A) information concerning courtroom utilization in the courthouse that is providing facilities that will be provided in the proposed courthouse;

        ‘(B) information concerning anticipated courtroom utilization in the proposed courthouse;

        ‘(C) information concerning anticipated facilities sharing in the proposed courthouse; and

        ‘(D) an analysis of whether the project conforms to the United States Court Design Guide.’.

    (b) TRANSMITTAL OF DESIGN GUIDE- Section 7 of the Public Buildings Act of 1959 (40 U.S.C. 606) is amended by adding at the end the following:

    ‘(g) TRANSMITTAL OF DESIGN GUIDE- On an annual basis, the Administrator shall obtain from the Administrative Office of the United States Courts, and shall transmit to Congress, the United States Court Design Guide, including any revisions to the Guide. Together with each Guide, the Administrator shall also transmit a report containing a statement by the Administrator as to the effects of any revisions to the Guide on courthouse construction costs and such other information as the Administrator considers appropriate.’.

SEC. 3. ACQUISITIONS OF PUBLIC BUILDINGS AND SITES BY EXCHANGE.

    Section 13 of the Public Buildings Act of 1959 (40 U.S.C. 612) is amended by adding at the end the following:

    ‘(8) The term ‘exchange’ includes an exchange for future rights or benefits, including rights or benefits relating to the development of real property.’.

SEC. 4. PROCEEDS FROM SALES AND LEASES.

    The Public Buildings Act of 1959 (40 U.S.C. 601 et seq.) is amended by adding at the end the following:

‘SEC. 22. PROCEEDS FROM SALES AND LEASES.

    ‘(a) DEPOSIT INTO FEDERAL BUILDINGS FUND- Notwithstanding any other provision of law, all proceeds received after the date of the enactment of this section from the sale of interests in real property, including buildings and other improvements thereto, controlled by the Administrator and from the leasing of space in public buildings located on such real property to private entities shall be deposited into the Federal Buildings Fund established by section 210(f) of the Federal Property and Administrative Services Act of 1949 (40 U.S.C. 490(f)).

    ‘(b) AVAILABILITY OF AMOUNTS- Moneys deposited into the Federal Buildings Fund pursuant to subsection (a) shall be available only for expenditure for repair and alteration activities and construction and acquisition of facilities activities in such amounts as are specified in annual appropriations Acts without regard to fiscal year limitations.’.
