Mr. NEUMANN introduced the following bill; which was referred to the Committee on National Security, and in addition to the Committee on International Relations, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned


A BILL

To require the destruction of the United States stockpile of landmines other than self-destructive landmines and to prohibit the acquisition of such landmines in the future.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ‘Nonself-Destructive Landmine Stockpile Elimination Act’.

SEC. 2. ELIMINATION OF UNITED STATES STOCKPILE OF NONSELF-DESTRUCTIVE LANDMINES.

    (a) REQUIREMENT- The Secretary of Defense shall demilitarize the United States stockpile of the landmines referred to in subsection (b). Such demilitarization shall be completed not later than December 31, 1998.

    (b) COVERED LANDMINES- The stockpile demilitarization requirement under subsection (a) applies to the following landmines:

      (1) The M14 antipersonnel landmine.

      (2) The M16 antipersonnel landmine.

      (3) The M15 antitank landmine.

      (4) The M19 antitank landmine.

      (5) The M21 antitank landmine.

SEC. 3. PROHIBITION ON ACQUISITION OF ADDITIONAL NONSELF-DESTRUCTIVE LANDMINES.

    No funds appropriated for the Department of Defense may be used for the acquisition of any landmine referred to in section 2(b) or for any other antipersonnel or antitank landmine that is not self-destructive.

SEC. 4. APPLICABILITY OF SECTIONS 2 AND 3 CONTINGENT UPON CERTIFICATION BY SECRETARY OF DEFENSE.

    The Secretary of Defense shall certify to the Congress, not later than December 31, 1998, whether or not compliance with section 2 would adversely affect the national security interest of the United States. If the certification of the Secretary is that compliance with that section would adversely affect the national security interest of the United States, sections 2 and 3 shall cease to be in effect.

SEC. 5. SENSE OF THE CONGRESS CALLING ON OTHER NATIONS TO ELIMINATE NONSELF-DESTRUCTIVE LANDMINES FROM THEIR MILITARY INVENTORIES.

    It is the sense of the Congress that all other nations should take steps, consistent with their own national security interests, to eliminate nonself-destructive landmines from their military inventories.
