A BILL

To provide for the liquidation or reliquidation of certain customs entries of nuclear fuel assemblies.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. NUCLEAR FUEL ASSEMBLIES.

    Notwithstanding section 514 of the Tariff Act of 1930 or any other provision of law, upon proper request filed with the Customs Service before the 90th day after the date of enactment of this Act, the customs entries listed in section 2 shall be liquidated or reliquidated as if, at the time such entries were made, the following additional U.S. note to chapter 84 of the Harmonized Tariff Schedule of the United States was in effect:

      ‘3. Subheading 8401.30.00 applies only to fuel rods which are collected into bundles to form fuel assemblies. Enriched uranium compound shipped abroad and converted into sintered, enriched uranium dioxide pellets and then inserted into zirconium alloy tubing which is sealed by the means of plugs which are welded into either end are to be classified as follows:

        ‘(a) The uranium pellets are to be classified under subheading 2844.20.00 as uranium oxide.

        ‘(b) The zirconium tubing is to be classified as an article of base metal under subheading 8109.90.00.’.

SEC. 2. APPLICATION.

    Section 1 shall apply to each of the following entries, and the Secretary of the Treasury shall refund the amount by which the duty previously posted or paid on such entry exceeds the amount of duty that would have been paid on such entry if the provisions of section 1 were in effect on the date of such entry:
