Mr. ROGAN introduced the following bill; which was referred to the Committee on Education and the Workforce


A BILL

To amend the Individuals with Disabilities Education Act to provide full funding for assistance for education of all children with disabilities.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ‘IDEA Funding Clarification Act’.

SEC. 2. AMOUNT OF GRANT FOR STATES UNDER PART B OF THE INDIVIDUALS WITH DISABILITIES EDUCATION ACT.

    (a) IN GENERAL- Section 611(a)(2) of the Individuals with Disabilities Education Act (20 U.S.C. 1411(a)(2)) is amended--

      (1) in the heading, by striking ‘MAXIMUM AMOUNTS’ and inserting ‘AMOUNTS’; and

      (2) in the matter preceding paragraph (1)--

        (A) by striking ‘maximum’; and

        (B) by striking ‘may’ and inserting ‘shall’.

    (b) CONFORMING AMENDMENTS- Section 611 of the Individuals with Disabilities Education Act (20 U.S.C. 1411) is amended--

      (1) in subsection (d)--

        (A) in paragraph (1)--

          (i) by striking ‘(1) IN GENERAL- ’; and

          (ii) by striking ‘paragraph (2) or subsection (e), as the case may be’ and inserting ‘subsection (a)’; and

        (B) by striking paragraph (2); and

      (2) by striking subsection (e).
