A BILL

To amend title 10, United States Code, to restore military retirement benefits that were reduced by the Military Retirement Reform Act of 1986.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ‘Military Retired Pay Restoration Act of 1999’.

SEC. 2. REPEAL OF REDUCTION IN RETIRED PAY APPLICABLE TO POST-AUGUST 1, 1986, MEMBERS WITH LESS THAN 30 YEARS OF SERVICE.

    (a) REPEAL OF REDUCTION- Section 1409(b) of title 10, United States Code, is amended by striking paragraph (2).

    (b) CONFORMING AMENDMENTS- Such section is further amended--

      (1) in paragraph (1), by striking ‘paragraphs (2) and (3)’ and inserting ‘paragraph (2)’; and

      (2) by redesignating paragraph (3) as paragraph (2).

SEC. 3. REPEAL OF REDUCED COST-OF-LIVING ADJUSTMENT APPLICABLE TO RETIRED PAY OF POST-AUGUST 1, 1986, MEMBERS.

    (a) REPEAL OF ADJUSTMENT- Section 1401a of title 10, United States Code, is amended--

      (1) in subsection (b), by striking paragraphs (1) and (2) and inserting the following:

      ‘(1) IN GENERAL- Effective on December 1 of each year, the Secretary of Defense shall increase the retired pay of each member and former member by the percent (adjusted to the nearest one-tenth of 1 percent) by which--

        ‘(A) the price index for the base quarter of that year, exceeds

        ‘(B) the base index.’; and

      (2) by striking subsection (e).

    (b) CONFORMING AMENDMENTS- Such section is further amended--

      (1) in subsection (b)--

        (A) by striking paragraphs (3) and (4); and

        (B) by redesignating paragraph (5) as paragraph (2);

      (2) in subsections (c) and (d), by striking ‘who first became a member of a uniformed service before August 1, 1986,’; and

      (3) by redesignating subsections (f), (g), and (h) as subsections (e), (f), and (g), respectively.

SEC. 4. CONFORMING AMENDMENTS.

    (a) REPEAL OF RESTORAL OF FULL RETIREMENT AMOUNT AT AGE 62 FOR MEMBERS ENTERING SERVICE ON OR AFTER AUGUST 1, 1986- (1) Section 1410 of title 10, United States Code, is repealed.

    (2) The table of sections at the beginning of chapter 71 of such title is amended by striking the item relating to section 1410.

    (b) AMENDMENTS TO SURVIVOR BENEFIT PLAN- (1) Section 1447(6)(A) of such title is amended by striking ‘(determined without regard to any reduction under section 1409(b)(2) of this title)’.

    (2) Section 1451 of such title is amended--

      (A) in subsection (h)--

        (i) in the heading, by striking ‘ADJUSTMENTS TO BASE AMOUNT’ and inserting ‘PERIODIC ADJUSTMENTS FOR COST-OF-LIVING’;

        (ii) by striking paragraphs (2) and (3);

        (iii) by striking ‘(1) PERIODIC ADJUSTMENTS FOR COST-OF-LIVING- ’; and

        (iv) by redesignating subparagraphs (A) and (B) as paragraphs (1) and (2), respectively, and realigning those paragraphs so as to be 2 ems from the left margin; and

      (B) by striking subsection (i).

    (3) Section 1452 of such title is amended--

      (A) in subsection (c), by striking paragraph (4); and

      (B) by striking subsection (i).

    (4) Section 1460(d) of such title is amended by striking ‘or recomputed under section 1452(i) of this title’, ‘or recomputed, as the case may be,’ and ‘or recomputation’.
