Mr. HUTCHINSON introduced the following bill; which was read twice and referred to the Committee on Energy and Natural Resources


A BILL

To modify the full payment amount available to States under the Secure Rural Schools and Community Self-Determination Act of 2000, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ‘Rural School and Community Enhancement Act’.

SEC. 2. DEFINITIONS.

    In this Act:

      (1) DOCUMENT- The term ‘document’ means the document prepared by the Forest Service entitled ‘P.L. 106-393, Secure Rural Schools and Community Self-Determination Act’ and dated July 31, 2001.

      (2) ELIGIBLE COUNTY- The term ‘eligible county’ has the meaning given the term in section 3 of the Secure Rural Schools and Community Self-Determination Act of 2000 (16 U.S.C. 500 note; Public Law 106-393).

      (3) ELIGIBLE STATE- The term ‘eligible State’ has the meaning given the term in that section.

      (4) REVISED DOCUMENT- The term ‘revised document’ means the revision to the document prepared under section 751(b) of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2002 (Public Law 107-76; 16 U.S.C. 500 note), and dated March 1, 2002.

      (5) SECRETARY- The term ‘Secretary’ means the Secretary of the Treasury.

SEC. 3. ELECTION OF FULL PAYMENT AMOUNT.

    (a) ELECTION-

      (1) IN GENERAL- Notwithstanding section 101(a)(1) of the Secure Rural Schools and Community Self-Determination Act of 2000 (Public Law 106-393; 16 U.S.C. 500 note), an eligible State may make a 1-time election to receive each full payment amount under section 102 of that Act for fiscal years 2002 through 2006 in an amount--

        (A) calculated in accordance with the document, and adjusted in accordance with section 101(b) of that Act; or

        (B) calculated in accordance with the revised document, and so adjusted.

      (2) NOTIFICATION OF ELECTION- Not later than September 30, 2002, each eligible State shall notify the Secretary of an election made under paragraph (1).

      (3) FAILURE TO MAKE NOTIFICATION- If an eligible State fails to notify the Secretary of an election made under paragraph (1) by September 30, 2002, the full payment amount for the eligible State for fiscal years 2002 through 2006 shall be calculated in accordance with the revised document and adjusted in accordance with section 101(b) of that Act.

    (b) DISTRIBUTION OF FULL PAYMENT AMOUNT TO ELIGIBLE COUNTIES- In carrying out section 102(c)(1) of the Secure Rural Schools and Community Self-Determination Act of 2000 (Public Law 106-393; 16 U.S.C. 500 note), an eligible State may distribute the full payment amount determined under subsection (a) among eligible counties that have elected to receive a share of the full payment amount, taking into consideration such factors as--

      (1) the historic percentage distribution of each eligible county, as described in the document; and

      (2) other factors that the eligible State determines to be appropriate.

    (c) CONFORMING AMENDMENT- Section 751(b) of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2002 (Public Law 107-76; 16 U.S.C. 500 note) is amended by adding at the end the following: ‘The payments shall be made in accordance with the ‘Rural School and Community Enhancement Act.’.
