When the Patient Protection and Affordable Care Act (popularly nicknamed Obamacare) was enacted in 2010, many were concerned that it gave the federal government too much control. So Congress included a provision allowing states flexibility to experiment and innovate in the healthcare space, so long as they received approval from the Centers for Medicare and Medicaid Services (CMS).

Named section 1332 waivers, after the provision in the law which authorized them, the waivers were first made eligible in 2017. By June 2021, CMS had approved 16 states’ applications.

Most of these haven’t proved controversial, until now.
