Mallory was the representative for Kentucky’s 5th congressional district and was an Unionist. He served from 1863 to 1865.

He was previously the representative for Kentucky’s 7th congressional district as an Unionist from 1861 to 1863; and the representative for Kentucky’s 7th congressional district as an Ind. Republican-Democrat from 1859 to 1861.
